Terms & Conditions
Rescheduling - If under special circumstances out of your control, you can't make your appointed time and date you are eligible to reschedule one (1) time within thirty (30) days of your original booking date and time.

Refunds - There are no refunds for images after you leave my studio or I (Monica L. Hernandez) leave your location. The purpose of you and I reviewing the images together during and after the photo session and your (the client) approval of each individual image, is to ensure you are fully satisfied with the images you are purchasing. Once the session is over, it's your responsibility to work with the images that we decided to keep and I accept no responsibility should you feel any other way. I have no problem deleting shots during the editing process in order to only keep the best of the best or photograph more to make sure we get the shots you want. I do feel that I have an incredible eye and know my work, however, I have no control over how others (agent, publicist, spouse, friends, etc.) will react to your session after you leave my studio. If, for any reason, something causes you to doubt the marketability of any part of your session and you would like to add another look or two, I charge a $100 fee for another hour of shooting. As stated above, anything that you feel could be improved upon should be discussed during your session in order to avoid having to come back for an additional hour. This offer is only available for 30 (thirty) days from your original session and after that, you are free to update at any time by booking another session at the then-current price at the time of booking.

Photo Delivery - (proof galleries only available with group/corporate packages) The approved shots will be made available on your own password-protected proofing website. Shots are usually posted before you leave the studio or shortly thereafter. You will be able to give the passcode to friends, family, agents, or anyone else who might help you choose the shots you decide to use. You can also share the images through social media via the links you'll see next to each image in your gallery. The site is a perfect tool for choosing your shots and remains online for a minimum of 7 (seven) days from your shoot date but no more than 30 (thirty) days.

Retouching and Printing - For quality control purposes I prefer all of my work to be handled by my preferred retoucher and/or lab and i don't release unedited, high-resolution images directly to my clients unless you elect to purchase a full buyout of your entire session for $1,200. Should you choose this option, you are free to take the images to a lab/retoucher of your choice so long as my brand is not associated with the final product in any way.

Failure to Perform - If Monica L. Hernandez (The Photographer) cannot perform this Agreement due to a fire or other casualty, strike, act of God, or other cause beyond the control of the parties, or due to Photographer’s illness, then the Photographer shall return the deposit to the Client but shall have no further liability with respect to the Agreement. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the Photographer. In the event the Photographer fails to perform for any other reason, the Photographer shall not be liable for any amount in excess of the retail value of the Client’s order.

Copyright and Reproductions - Monica L. Hernandez (The Photographer) shall own the copyright on all images created and shall have the exclusive right to make reproductions and edits of any kind. The Photographer shall only make reproductions for the Client or for the Photographer’s portfolio, samples, self-promotions, entry in photographic contests or art exhibitions, editorial use, website, or for display within or on the outside of the Photographer’s studio.
